Specific Plan Administration

7.10 Introduction

The requirements contained herein will be administered recognizing that this specific plan is a customized zoning document for North Star, defining allowable land use, required improvements, and other requirements.  Any procedure or administrative requirement not addressed in this document will be defined by the City=s prevailing zoning ordinance and then-current administrative procedures applied to property development throughout the City.

7.20 Specific Plan Recovery Fees

In accordance with the provisions of State Law (Government Code Section 65456), the applicant=s funding of this specific plan could be subject to reimbursement.  The applicant for this specific plan preparation expressly elected not to require reimbursement.  The plan may be amended to require reimbursement by following the specific plan amendment procedures outlined below.

7.30    Specific Plan Amendment Procedures

This specific plan may be amended based on an application filed with the City, by any applicant with the written consent of the then-current property owner(s).  Such amendment requests shall be processed by the City in a manner identical to a General Plan Amendment and Zone Change application.  The application may be subject to environmental review if the City determines that additional impacts may occur over and above those that were anticipated in the specific plan environmental impact report.  The applicant shall pay prevailing City processing fees.  This procedure shall include noticed public hearings by both the Planning Commission and City Council.
